No significant fiscal implication to the State is anticipated.

Data currently collected through the Public Education Information Management System (PEIMS) indicate whether a student was served in a special education program at some time during the school year.  This indicator can be matched with student disciplinary records, but it is not specifically reported in reference to an incident that resulted in disciplinary action.  Under current reporting structures, student disciplinary records indicate whether the term of a disciplinary placement is altered due to incarceration or other judicial action.
 
It is assumed that a special education indicator specific to each disciplinary incident reported would be added to the PEIMS student disciplinary record to meet the requirements of the bill.  Because the data required in the bill for the most part is available within current state and local data systems and because it is assumed that the indicator could be added through the standard PEIMS review and modification processes, no significant costs to the operations of the Texas Education Agency would be anticipated under the provisions of this bill.  It is assumed that the existing special education enrollment indicator would be used to meet the bill’s reporting requirement until the new incident-specific indicator could be implemented under the standard process.

Local Government Impact

Because the data required in the bill for the most part is available within current local data systems and because it is assumed that the indicator could be added through the standard PEIMS review and modification processes, no significant costs to school districts would be anticipated under the provisions of this bill.  It is assumed that existing special education enrollment indicator data would be used to meet the bill’s reporting requirement until the new incident-specific indicator could be implemented under the standard PEIMS revision process.
