LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

March 3, 2007

TO:
Honorable Rob Eissler, Chair, House Committee on Public Education

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB849 by Olivo (Relating to transportation to and from a disciplinary alternative education program or juvenile justice alternative education program and the length of a school day at a disciplinary alternative education program.), As Introduced

No fiscal implication to the State is anticipated.

The bill would require off-campus disciplinary alternative education programs (DAEPs) to operate for seven hours each day and would require school districts to provide transportation for students to and from the DAEP.  The bill would require school districts or county juvenile boards to provide for transportation for students to and from the juvenile alternative education program.

Changes made by the bill would not affect the attendance accounting procedures currently in effect.  Since the bill does not amend Texas Education Code 42.2516 relating to the calculation of district entitlement under the Foundation School Program, no net fiscal impact to the state would accrue associated with increases to the transportation allotment resulting from the provisions of the bill.

Local Government Impact

To the extent that DAEPs operating hours are increased under the provisions of the bill, local school district costs could be increased.  Additional costs associated with requirements related to student transportation would be borne by local entities.  Those costs would vary.
