No fiscal implication to the State is anticipated.
The bill would amend the Penal Code to change from a Class C misdemeanor to a Class B misdemeanor the offense of failure to identify. The bill would also change from a Class B misdemeanor to a Class A misdemeanor if it is shown on the trial for an offense of failure to identify when the defendant was lawfully arrested or lawfully detained that at the time the person was a fugitive from justice. Enhancement of the offense level could result in higher fines imposed and collected and in an increase in use of local jail beds.
