No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code relating to the duties of certain health care facilities in reaction to residents who are sex offenders.

The bill would amend Health and Safety Code, Chapters 242 and 246, which would require certain institutions (nursing facilities, continuing care facilities, and assisted living facilities) to use the sex offender database maintained by the Department of Public Safety (DPS) to determine if facility residents are required to register as sex offenders.  The institution must make this required screening no later than three days after the individual begins to reside in the facility.

The bill would take effect on September 1, 2007.

The Department of Public Safety and the Department of Aging and Disability Services both state that they anticipate no significant fiscal impact to their agencies.  This analysis assumes that costs associated with the bill can be absorbed within each agency’s current appropriations.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
