LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

March 1, 2007

TO:
Honorable Rob Eissler, Chair, House Committee on Public Education

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB958 by Bonnen (relating to certain requirements imposed on a sex offender who enters the premises of a school. ), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to add to the list of what the Texas Department of Criminal Justice (TDCJ) is required to inform a sex offender prior to their release from prison that if the person goes onto the premises of a school that the person must immediately notify the administrative office of the school of their presence and of their sex offender status. Provisions of the bill would also require local law enforcement agencies that provide a person with a sex offender registration form to include with that form a statement and description of the person's duty to provide notice to a school upon entering the school's premises. The school would be authorized to provide a chaperone to accompany the sex offender while that person is on the school's campus.

It is anticipated that any costs associated with revising or creating lists of information or statements of requirements for a sex offender could be absorbed using existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
