No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 321 of the Tax Code to require the Comptroller, upon request, to provide municipal sales tax information to a municipality that had adopted a sales tax.

Under the bill, the Comptroller would provide information relating to the amount of tax paid to the municipality during the preceding or current calendar year by each person doing business in the municipality who annually reports state and local sales tax payments of more than $25,000.

For municipalities that do not impose an ad valorem tax, the Comptroller would provide the same information by each person doing business in the municipality who annually reports state and local sales tax payments of more than $500.

The bill would require the mayor or the chief administrative officer to make a separate request for information in writing each year.

This bill would take effect immediately upon enactment, assuming that it received the requisite two-thirds majority votes in both houses of the Legislature. Otherwise, it would take effect September 1, 2007.

Under current law, municipalities that have adopted a sales tax and that have a population of not more than 275,000 may request this detailed sales tax information from the Comptroller. The bill would increase the information provided to municipalities that do not impose an ad valorem tax. The bill would significantly increase the number of municipalities that could request this information.
