LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

May 3, 2007

TO:
Honorable Kip Averitt, Chair, Senate Committee on Natural Resources

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1032 by Puente (Relating to amendments to regional water plans.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Water Code regarding procedures for amending regional water plans. The bill would allow expedited amendments to regional water plans in very limited circumstances. The revised process for proposed amendments would require water planning groups to post proposed amendments on the group's meeting agenda for consideration at a planning group meeting and the public would be provided an opportunity to comment on the proposed amendment at the meeting. The bill would eliminate the requirement to file a proposed amendment with local newspapers, to mail individual notices, to hold a separate public hearing, and to allow a 30-day comment period. A proposed amendment could only go through the expedited notice process if it is found eligible by the executive administrator of the Texas Water Development Board.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
