No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code by adding that the Texas Department of Criminal Justice (TDCJ) shall adopt policy allowing any nonprofit or public health care agency to distribute condoms to inmates and state jail defendants confined in facilities operated by or under contract with TDCJ. The bill further states that TDCJ policy provide the disposal of used condoms in a manner that protects the anonymity of inmates and the health of health department employees, inmates and state jail defendants. The Texas Department of Criminal Justice has determined that the cost of implementing the bill would not be significant.
