No significant fiscal implication to the State is anticipated.

The bill would amend Human Resources Code, Chapter 141, Subchapter C to prohibit the Juvenile Probation Commission from permitting medical, pharmaceutical, or cosmetic research to be conducted on a child in the juvenile probation system. The prohibition would not apply to surveys, questionaires, studies based solely on medical records, claims data or outcome data, studies employing neurocognitive testing, or studies using noninvasive brain imaging, including magnetic resonance imaging. The prohibition also would not apply if a district court in Travis County, a district court whose jurisdiction includes the county of the youth's residence or placement, or a court with continuing jurisdiction over the youth's case has determined that the research program is in the best interest of the youth. 

 

The Juvenile Probation Commission (JPC) would be required to maintain records relating to youth in the probation system that participated in research programs or studies. JPC would be required to regularly submit a report of the information in the records to the governor and the legislature. The bill would add Section 58.0052 to the Family Code which would describe the agencies which would be required to share information regarding at-risk youth for the purpose of protecting the community and providing services to at-risk youth.  The bill would take effect immediately if it receives a two-thirds vote in each house, or on September 1, 2007 if it does not receive the necessary vote. JPC anticipates the bill would have no significant fiscal impact to the State.
