No significant fiscal implication to the State is anticipated.

The bill would require physicians to report to the Department of State Health Services (DSHS) on complications resulting from an elective termination or attempted elective termination. The bill would require DSHS to maintain a toll-free telephone number for physicians to submit reports. DSHS indicates an existing toll-free telephone number can be used for submitting the required reports.

The bill would require the Health and Human Services Commission (HHSC) to adopt rules to administer provisions of the bill. It is assumed rules could be adopted using the existing resources of HHSC.

The bill would provide for sanctions, including administrative penalties, for physicians who intentionally violate certain provisions of the bill or related rules. The Texas Medical Board indicates there would not be a significant fiscal impact from sanctions.
