No significant fiscal implication to the State is anticipated.


Currently, mothers are entitled to breast-feed in any location in which the mother is authorized to be. The bill prohibits a mother's authority to be in a location from being revoked because she is breast-feeding. Persons are barred from interfering with or restricting the right of a mother to breast-feed in any place held open to the general public or any place owned or operated by an entity from which the comptroller collects taxes or which holds a license or permit issued by the comptroller. The comptroller is required to notify each business of the right of a mother to breast-feed and the prohibition against interference with or restriction of that right. Civil penalties for violation are authorized. Civil penalties recovered are deposited to the state treasury if suit was brought by the attorney general or in the general fund of a county if suit was brought by a district or county attorney.

There could be an increase in revenue from civil penalties but the Office of the Comptroller of Public Accounts indicates that fiscal impact cannot be estimated.
