LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

March 24, 2007

TO:
Honorable Frank Corte, Jr., Chair, House Committee on Defense Affairs & State-Federal Relations

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1163 by Gallego (Relating to tuition and fee exemptions at public institutions of higher education for the spouses of certain military personnel.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Education Code Section 54.203(b) related to tuition and fee exemptions for children of Texas National Guard members who died while on active duty, extending the exemption to spouses. Surviving spouses would be eligible for the exemption for a period of ten years after the anniversary date of the National Guard member's death or until they remarry. The act would effect tuition charges beginning with the fall 2007 semester.

Extending the exemptions to spouses will not have a significant impact on tuition and fee revenue due to the fact that it will effect very few students.

Local Government Impact

No fiscal implication to units of local government is anticipated.
