LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

February 16, 2007

TO:
Honorable Mike Krusee, Chair, House Committee on Transportation

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1184 by King, Tracy (Relating to the offense of obstructing a railroad crossing with a train.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Transportation Code by increasing the fine for the misdemeanor offense of obstructing a railroad crossing with a train. The bill would also lower from 10 minutes to 5 minutes the amount of time a street, railroad crossing, or highway is obstructed by a train that creates an offense.

Under current statute, the fine is between $100 and $300. The proposed change to statute would increase the fine to $1,000 if the obstruction lasts 10 minutes or less and an additional $1,000 for each five minute interval that the obstruction continues beyond 10 minutes.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
