LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

May 16, 2007

TO:
Honorable Kip Averitt, Chair, Senate Committee on Natural Resources

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1235 by Driver (Relating to the regulation by the Texas Commission on Environmental Quality of the idling of a motor vehicle while the driver is using the vehicle's sleeper berth.), As Engrossed

No significant fiscal implication to the State is anticipated.

The proposed legislation would extend until September 1, 2009 current law that prohibits the Commission on Environmental Quality  from adopting rules to limit vehicles idling if the vehicle is idling in order to power a heater or air conditioner while the driver is using the sleeper berth for a government-mandated rest period. It would also state that idling is not necessary if heating and air conditioning connections are available within two miles, and prohibit idling near hospitals and school zones. These provisions would otherwise expire on September 1, 2007.

Local Government Impact

No fiscal implication to units of local government is anticipated.
