No significant fiscal implication to the State is anticipated.

The bill would authorize the Texas Commission on Environmental Quality (TCEQ) to renew a preconstruction permit when a permit amendment that requires public notice is submitted to the TCEQ no more than 36 months before the date of permit expiration. The bill would also  authorize the TCEQ, for cause, to establish a permit term for a preconstruction permit issued for a nonfederal source not to exceed 10 years.

According to the TCEQ, adjusting the renewal schedule to coincide with an amendment, under the specified circumstances, will make more efficient use of agency resources without reducing the opportunity for public input. Any administrative impacts to the agency would be minimal.
