FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1299 by Strama (Relating to governmental liability for a violation of the federal Americans with Disabilities Act.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend statute and waive state agencies’ sovereign immunity from suit and liability for claims under the Americans with Disabilities Act. It is assumed that any additional costs associated with implementation of the bill could be absorbed within existing state resources.

The bill would take effect September 1, 2007.

Local Government Impact

Costs to a governmental unit would depend upon the number of cases filed and the number of judgments against a governmental unit.
