Fiscal Analysis

The bill allows institutions of higher education to request background checks from the Department of Public Safety for students applying for admission and for students who are enrolled. Currently there is a $1.00 fee for criminal history record checks conducted through name searches.

Methodology

Based on the analysis of Department of Public Safety (DPS), it is assumed the bill would require an additional 238,744 criminal history records checks to be conducted in fiscal years 2008 through 2010 and 230,711 criminal history records checks to be conducted in fiscal years 2011 to 2012. Based on the $1.00 fee currently assessed for criminal history record checks conducted though name searches, the record checks would generate $238,744 in additional General Revenue collections for fiscal years 2008 through 2010 and $230,711 in fiscal years 2011 to 2012. It is assumed these revenues would be appropriated to DPS to pay for the administrative expenses of the criminal history program.

Currently, DPS provides this service and would need additional FTEs due to increased workload for post secondary educational institutions. The analysis assumes that the agency's costs would equal the revenue generated and would be used to hire five additional FTEs.

Local Government Impact

No fiscal implication to units of local government is anticipated.
