IN RE:
HB1368 by Hochberg (Relating to maintaining or participating in a public nuisance.), As Introduced
No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code to authorize the district, county, or city attorney or the attorney general, to take actions if, after notice and hearing on a request by a petitioner for a temporary injunction regarding a public nuisance, a court determines that there has been a violation of an injunctive order. Under current statute, the political subdivision is the entity authorized to take the actions outlined in statute.
Local Government Impact
No significant fiscal implication to units of local government is anticipated.
