LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

March 8, 2007

TO:
Honorable Will Hartnett, Chair, House Committee on Judiciary

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1388 by Naishtat (Relating to the duty of the judge of the 147th District Court to impanel grand juries and to the terms of court for certain district courts in Travis County.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend Chapter 24 of the Government Code by authorizing the 147th District Court to empanel grand juries when the court considers it necessary. Under current statute, the court is required to impanel a grand jury for each court term.

The bill would also amend the Government Code relating to the terms of court of the 147th and 167th District Courts, both of which are located in Travis County. The bill would replace four annual terms of court with two annual terms of court.

Local Government Impact

The bill would generate minimal savings to local government by reducing the number of grand juries empanelled during the year, potentially reducing the amount of expenditures for delivery, interrogation of potential jurors, administration of oaths, and responses to challenges to the array or an individual juror.

No significant fiscal implication to units of local government is anticipated.
