No fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to authorize a county that adopts abatement procedures that are consistent with the general purposes of Chapter 343 to abate a nuisance that is a swimming pool by prohibiting or controlling access to the premises where the swimming pool is located and by installing a cover that cannot be opened by a child over the entire swimming pool or by draining and filling the pool. A county would be authorized to take those actions prior to conducting a hearing regarding the nuisance.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.
