No significant fiscal implication to the State is anticipated.

The bill would amend the Election Code by establishing a timeframe of 60 days after an election for the length of time voted ballots shall be preserved securely in a locked room in the locked ballot box in which they were delivered to the general custodian of election records. The bill would authorize the general custodian on the 61st day after election to require that the key to the ballot box be returned to the custodian and the ballots be transferred to another secure container for the remainder of the preservation period.

The bill would repeal Section 66.058(g), Election Code, thereby removing the requirement that the Secretary of State instruct affected authorities on the actions necessary for compliance with federal law relating to preserving precinct election records.
