The bill would amend the Government Code relating to access to criminal history records information by the Guardianship Certification Board. The bill would authorize the board to obtain criminal history information maintained by the Department of Public Safety relating to applicants or active guardians, provided the board destroys the information after it is used for authorized purposes. To the extent the bill would modify procedures relating to criminal history records for guardians or applicants to be guardians, no significant fiscal implication to the State is anticipated.
The bill would take immediate effect if the bill receives two-thirds the vote of members; otherwise, the bill would take effect September 1, 2007.
