FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

May 1, 2007

TO:
Honorable Royce West, Chair, Senate Committee on Intergovernmental Relations

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1491 by Woolley (Relating to disclosure of certain relationships with local government officers.), As Engrossed

No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code regarding requirements for filing a conflicts disclosure statement. The bill would add charter schools to those entities affected by conflicts disclosure statement requirements. Included in the proposed changes to procedures related to conflicts disclosure statements is clarification that a local governmental entity does not have a duty to ensure certain persons file a conflict of interest questionnaire; that a local governmental entity is not required to maintain an Internet website, although if the entity maintains a website they are required to post access to statements and questionnaires; and that the governmental entity is not required to disclose information that is excepted from disclosure by Chapter 552, Government Code.

Provisions of the bill would require a records administrator to maintain conflict disclosure statements and questionnaires in accordance with retention schedules.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
