No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure relating to presentence or posentence investigations or reports and to certain conditions of community supervision based on those investigations or reports.  The bill would remove requirements that a supervision officer report to the judge the amount of restitution necessary to compensate victims and proposed client supervision plans, unless such information is requested by the judge in exercising the judge’s sentencing discretion.  The bill would repeal provisions in the code relating to offenses committed under the influence of drugs and alcohol, defendants with mental impairments, and qualifications of social workers.  To the extent the bill would amend criminal case proceedings, the fiscal implication to the State is not anticipated to be significant.  The bill would take effect September 1, 2007.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
