No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code relating to an exception from civil discovery for certain records of a law enforcement agency.  The bill would direct a court to exclude a nonparty law enforcement agency from providing information, records, documents or other evidence in response to discovery unless a court has found the requested materials are relevant in a judicial proceeding under certain conditions.  To the extent the bill would change court procedures regarding discovery, no significant fiscal implication to the State is anticipated. 

 

The bill would take immediate effect if the bill receives two-thirds the vote of all members; otherwise, the bill would take effect September 1, 2007.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
