The bill would amend the Civil Practice and Remedies Code relating to an exception from civil discovery for certain records of a law enforcement agency. The bill would direct a court to exclude a nonparty law enforcement agency from providing information, records, documents or other evidence in response to discovery unless a court has found the requested materials are relevant in a judicial proceeding. To the extent change court procedures regarding discovery, no significant fiscal implication to the State is anticipated.
The bill would take immediate effect if the bill receives two-thirds the vote of all members; otherwise, the bill would take effect September 1, 2007.
