No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code relating to promulgation of Supreme Court rules for an exception to discovery in civil cases for nonparty law enforcement agencies.  The bill would direct the supreme court to provide rules that exempt a peace officer employed by a governmental agency from providing information, records, documents or other evidence in response to discovery unless a court has found the requested materials are relevant in a judicial proceedings.  The court would need to promulgate the rules no later than January 1, 2008.  To the extent the bill would direct the Supreme Court to promulgate rules and change court procedures regarding discovery, no significant fiscal implication to the State is anticipated. 

 

The bill would take immediate effect if the bill receives two-thirds the vote of all members; otherwise, the bill would take effect September 1, 2007.

No significant fiscal implication to units of local government is anticipated.
