No fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to require the civil or administrative penalty for violating an ordinance to enforce compliance with the instructions of a traffic-control signal to be set at $75.

Local Government Impact

The fiscal impact on units of local government would vary depending on the number of violations that occur as well as what penalty amounts are currently imposed. For example, the City of Houston Police Department reports that City Ordinance #2004-1312 imposes a civil or administrative penalty that may exceed the proposed $75 when there are multiple violations related to the same vehicle or when the violator is delinquent in paying the fine imposed. Under the provisions of the bill, therefore, the city would experience a loss in revenue.
