LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

March 29, 2007

TO:
Honorable Fred Hill, Chair, House Committee on Local Government Ways & Means

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1655 by Davis, Yvonne (Relating to prohibiting the posting of certain tax appraisal record information on the Internet.), As Introduced

No fiscal implication to the State is anticipated.

The bill would add Section 25.028 to the Tax Code to allow owners of property included in an appraisal record to prohibit an appraisal district, a taxing unit, or an assessor-collector from posting their name on the Internet. The entity that posts appraisal record information on the Internet would have to give notice on the Internet site of the availability of the right to prohibit the posting of owner names. An owner would make a prohibition request on a form prescribed by the Comptroller.

Because the state is constitutionally prohibited from imposing a state property tax, there would be no direct fiscal impact on the state.

The bill would take effect September 1, 2007.

Local Government Impact

Passage of this bill could result in additional administrative costs to appraisal districts and units of local government that are required to remove property owner names from appraisal district Internet sites.
