LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 20, 2007

TO:
Honorable Aaron Pena, Chair, House Committee on Criminal Jurisprudence

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1658 by Hochberg (Relating to information contained in a criminal street gang intelligence database. ), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 61, Code of Criminal Procedure, to add to what must be collected relating to criminal street gang information to be entered into a law enforcement agency's street gang database and to what must be considered when determining removal of information from the database.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.

It is assumed that the changes could result in some additional data entry or data removal, but that the fiscal impact would be insignificant.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
