No fiscal implication to the State is anticipated.

The bill would amend Section 1, Subchapter A, Chapter 814 of the Government Code by adding Section 814.012, which provides that a member of the elected class under Section 812.002(a) who is convicted of an offense classified as a felony, would become ineligible to receive service retirement benefits, disability retirement benefits, or death benefits payable by the retirement system. 
 
The bill would provide that a person who becomes ineligible for benefits may withdraw their accumulated contributions for service credit in the retirement system in the manner provided by Subchapter B, Chapter 812. Based on the analysis by the Employees Retirement System, the provisions of the bill would have no fiscal impact to the state.
 
The bill becomes effective on September 1, 2007 and applies only to an offense committed on or after the effective date of the bill.

Local Government Impact
