No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code by requiring when an officer charges a railway company for an offense under Section 471.007 that the officer deliver a copy of the citation to an employee or other agent of the railway company. The bill would apply only to an offense committed on or after the effective date of the bill, which would be September 1, 2007.

Under current statute, an officer has the choice to either attach a copy of the citation to the train or to deliver a copy to an employee or agent. It is anticipated that there would not be many such offenses committed; however, for each offense, additional officer time could be involved in delivering a copy of the citation if it becomes necessary to go somewhere other than the location of the offense to make the delivery, which would create a minimal cost.
