LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 2, 2007

TO:
Honorable Aaron Pena, Chair, House Committee on Criminal Jurisprudence

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB1800 by Martinez Fischer (Relating to enhancement of the punishment for certain intoxication offenses based on past convictions under federal law and the Uniform Code of Military Justice.), As Introduced

No significant fiscal implication to the State is anticipated.

This bill would amend the Penal Code adding violations of federal law or the Uniform Code of Military Justice to the list of previous intoxication convictions eligible for inclusion when considering penalty enhancement for certain intoxication offenses.

This bill would take effect September 1, 2007 and apply only to an offense committed on or after the effective date.

It is assumed the number of persons convicted under this statute would not result in a significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
