No fiscal implication to the State is anticipated.

The bill would amend Section 402, Local Government Code, by removing part of the population bracket criteria. Under current statute, the service area of a municipal drainage utility system cannot extend outside of its municipal boundaries except in a municipality with a population of more than 400,000 that is located in one or more counties of less than 600,000 or in a municipality all or part of which is located over or within the Edwards Aquifer recharge zone or transition zone.

The proposed revision would remove the requirement related to location within one or more counties of less than 600,000, which would result in the statute applying to all cities with a population of more than 400,000: Austin, Dallas, El Paso, Fort Worth, Houston, and San Antonio.
