No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to require the Texas Department of State Health Services (DSHS) in consultation with the Texas Department of Transportation to adopt rules to ensure the safe installation, operation, and transportation of propane storage tanks used by mobile food units. The bill would take effect September 1, 2007.

Currently, the Texas Railroad Commission is responsible for enforcing rules related to regulation of propane tank storage as listed under the Texas Natural Resources Code, Chapter 113. DSHS reports that the agency would propose propane rules for mobile food units in keeping with the Natural Resources Code. In addition, the agency would make minor changes to its current inspection form and guidance documents relating to the new provision. The training and changes to the inspection form and documents would be done with current staff.
