LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

March 30, 2007

TO:
Honorable Kevin Bailey, Chair, House Committee on Urban Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2023 by Bohac (Relating to the participation by certain state elected officials in the process for evaluating an application for a low income housing tax credit.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to allow state elected officials the opportunity to oppose an application for the low income housing tax credit program. The bill would also require the notification of members of the legislature whose district is within one mile of the proposed development, and allow these members to hold a district meeting at which the Texas Department of Housing and Community Affairs (TDHCA) would be required to provide appropriate representation.

Based on information provided by TDHCA, it is assumed that costs related to the duties and responsibilities associated with implementing the provisions of the bill could be covered by utilizing existing resources.

The bill would take effect immediately if it receives a vote of two-thirds of all the members elected to each house; otherwise, the bill would take effect September 1, 2007.

Local Government Impact

No fiscal implication to units of local government is anticipated.
