HB2068 by Hartnett (Relating to trial by special judge in civil and family law cases.), As Engrossed

No significant fiscal implication to the State is anticipated.

Under the bill a judge would be required to order referral of a civil or family law matter pending in a district court, statutory probate court or statutory county court to a special judge if the motion for referral states that there is no dispute among the parties to any issue of fact or law in the case. Currently under statute the judge is authorized but not required to order a referral.

 

The bill would take effect September 1, 2007.
