LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

March 26, 2007

TO:
Honorable Helen Giddings, Chair, House Committee on Business & Industry

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2069 by Hochberg (Relating to the processing of consumer rebates.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Business and Commerce Code to require persons who offer rebates to pay the rebate to the consumer within the time period specified in the offer or if silent, no later than the thirtieth day after the properly completed rebate request was received.  The Office of the Attorney General indicates that new investigations and cases could result for provisions of the bill but that any additional costs could be absorbed within current resources.

This Act takes effect September 1, 2007.

Local Government Impact

No fiscal implication to units of local government is anticipated.
