There would likely be a cost to the state to implement the bill; however cost estimates cannot be determined at this time. 

Costs would be related to the requirement to build a medical facility to house inmates released on medically recommended intensive supervision and to provide treatment services to eligible parolees.

Since the Department of Assistive and Rehabilitative Services (DARS) does not currently have the authority to provide these treatment services, it is assumed that these services would be provided by the Department on Aging and Disability Services (DADS). 


The bill would amend the Government Code as it relates to medical facilities for inmates released on medically recommended intensive supervision (MRIS).

Under current law, the Texas Correctional Office on Offenders with Medical or Mental Impairments (TCOOMMI) and the Texas Department of Human Services is authorized to request proposals from public or private vendors to provide under contract services for inmates released on MRIS.  The provisions of the bill would replace the Texas Department of Human Services with DARS. 

The bill would also authorize TCOOMMI and DARS to jointly: 1) with a real estate investment trust, enter into a lease agreement to finance, design, and build a medical facility to house inmates released on MRIS, 2) contract with a private vendor to provide treatment services.

DARS does not currently have the authority to provide these treatment services.  It is assumed that these services would be provided by the DADS and that such services would require additional appropriations.  However, costs cannot be estimated at this time.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
