No fiscal implication to the State is anticipated.
The bill would amend the Local Government Code to require a person who intends to construct or operate a chemical dependency treatement facility within 1,000 feet of a residential property, primary or secondary school, public park or public recreation area of the state or a political subdivision, or a place of worship to notify the governing body of the municipality in which the affected property is located. The municipality would be authorized to determine by resolution to deny consent for the construction or operation if a hearing is held and the resolution is issued before the 91st day after the date the municipality receives notice regarding the facility.
