No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to authorize the Texas Department of Transportation (TxDOT) to acquire real property for a highway purpose before the location or alignment of the highway has been determined if TxDOT determines that it is probable that the property will be necessary for the construction of the highway and private development in the area of the property is likely to make the future acquisition of the property more expensive or otherwise more difficult. The provisions of the bill would not apply to the acquisition of  property by eminent domain.

TxDOT indicates that the advanced acquisition of property for highway purposes could result in savings in the department's right-of-way costs. It is assumed any savings of highway funding realized by TxDOT as a result of the provisions of the bill would be applied to other transportation projects.

The bill would take effect immediately upon receiving a vote of two-thirds of all members elected to each house or otherwise on September 1, 2007.
