March 26, 2007

TO:
Honorable Dennis Bonnen, Chair, House Committee on Environmental Regulation

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2318 by Smith, Wayne (Relating to compliance histories for and incentives to reward compliance performance by entities regulated by the Texas Commission on Environmental Quality.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would make several changes to the Commission on Environmental Quality's compliance history processes. The agency reports that it will be required to modify its Consolidated Compliance and Enforcement Data System (CCEDs) Capital Budget project in order to accommodate changes to the compliance history formula resulting from the bill. The agency also reports that the bill could result in a decrease in enforcement penalties the agency would assess. No signficant fiscal implications are expected as a result of the bill's provisions.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
