HB2330 by Bailey (Relating to the applicability of the Fire and Police Employee Relations Act in recently incorporated political subdivisions to certain fire fighters covered by preexisting collective bargaining agreements.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend Chapter 174, Local Government Code, to require that if fire fighters employed by a private corporation to provide services in an unincorporated area are covered by a collective bargaining agreement when the unincorporated area incorporates as a political subdivision, the fire fighters would automatically become employees of the political subdivision and the collective bargaining agreement would be considered automatically adopted in relation to the political subdivision's fire fighters without an adoption election. The collective bargaining agreement would continue for the remainder of its term and unless the automatic adoption is repealed by an election.

Local Government Impact

A political subdivision under the circumstance would experience a savings by not having to conduct an adoption election. However, the political subdivision may incur costs it would not have otherwise incurred had a collective bargaining agreement not been in place, depending on the provisions of the agreement.
