Fiscal Analysis

The bill would require the agency to prepare a report identifying public education mandates imposed under state or federal law in Texas. The report would be required to separately identify each mandate, cite the law authorizing the mandate, indicate the degree to which the mandate is funded and the sources of funding for the mandate, estimate costs required to be paid by the state or the school districts, indicate whether the mandate duplicates or conflicts with another public education mandate, and make recommendations relating to revising or eliminating mandates.  The bill would direct the agency to solicit information relating to public education mandates from school districts, school district employees, and any other interested person.

The agency would be required to make the report produced under this section available as an electronic document on the agency's Internet website and to update the electronic document periodically to include any additions or changes.  The bill would require the agency to submit a copy of the report to the governor, legislative leadership, and the presiding officers of applicable standing committees by December 1, 2008.

The Texas Education anticipates significant cost in FY2008 to complete the initial report.  Lower ongoing costs in subsequent fiscal years would be incurred to update and maintain the required information.


Methodology

The agency estimates that one permanent full-time equivalent (FTE) staff member and two contract resource positions would be required to prepare the required report by December 2008. The agency assumes that one FTE would be needed in FY2009 and subsequent fiscal years to respond to inquiries and to update and maintain the information, including ongoing solicitation of input from school districts, school staff, and the public.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
