No fiscal implication to the State is anticipated.

The bill would amend Section 251.161, Transportation Code, by changing the penalty that would be imposed for violations of certain county traffic regulations. Punishment for an offense, regardless if it is a first or subsequent offense, would be a fine not to exceed $200. The bill would take effect September 1, 2007.

Under existing statute, punishment for a first offense under Section 251 is a fine up to $50. If it is shown at trial that the person has been previously convicted one time of an offense under Section 251, the punishment is a fine not to exceed $200, and for two or more previous convictions, a fine not to exceed $500, confinement in the county jail for up to 60 days, or both.

No significant fiscal implication to units of local government is anticipated.
