No fiscal implication to the State is anticipated.

The bill would amend Chapter 253, Transportation Code, to authorize a county commissioners court to improve a road in a subdivision or an access road to a subdivision in any part of the county. If a road in a subdivision or an access road to a subdivision is located in a municipality, the county would have to obtain permission from the municipality to improve the road.

The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.

Under current statute, the commissioners court has authority to improve a road in a subdivision or an access road to a subdivision only in the unincorporated area of the county.


Local Government Impact

Because existing statute allows a county commissioners court to assess all or part of the costs for improving the road against the record owners of the affected property, no significant fiscal impact is anticipated.
