LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

March 15, 2007

TO:
Honorable Wayne Smith, Chair, House Committee on County Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2591 by Bonnen (Relating to county improvement of subdivision roads.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend Chapter 253, Transportation Code, to authorize a county commissioners court to improve a road in a subdivision or an access road to a subdivision in any part of the county. Under current statute, the commissioners court has authority to improve a road in a subdivision or an access road to a subdivision only in the unincorporated area of the county.

Local Government Impact

Because existing statute allows a county commissioners court to assess all or part of the costs for improving the road against the record owners of the affected property, no significant fiscal impact is anticipated.
