LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 80TH LEGISLATIVE REGULAR SESSION

April 30, 2007

TO:
Honorable Patrick M. Rose, Chair, House Committee on Human Services

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2670 by Giddings (relating to providing notice to the Department of Family and Protective Services of investigations of family violence at certain foster homes.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would require that a peace officer make a report to the Department of Family and Protective Services (DFPS) when investigating or responding to family violence calls at a licensed foster home or verified agency foster home. The bill would require that DFPS maintain a database of licensed foster homes and verified agency foster homes and make the database available to the Department of Public Safety (DPS). DPS would be required to maintain the information in the Texas Crime Information Center database.

DFPS anticipates any costs associated with implementing the bill could be absorbed within its current resources. DPS indicates that there would be some system modification costs to implement the provisions of the bill, but these costs are expected to be absorbed within the agency's existing budget.

Local Government Impact

There would be some costs to local law enforcement agencies that employ peace officers to implement the provisions of the bill. There would be more personnel hours expended to contact and utilize the information in the Texas Crime Information Center. These costs would depend on the number of family violence incidents or allegations encountered by the local peace officers.
