No fiscal implication to the State is anticipated.
The bill would prohibit the Texas Commission on Environmental Quality (TCEQ) from adopting or enforcing a rule, determination, or order limiting emissions from residential water heaters to less than 40 nanograms of nitrogen oxides (NOx) per joule unless a lower limit is established by a federal statute or rule. The bill would also remove language directing the TCEQ to replace emissions redcutions related to residential gas water heaters that are not adoped by the Commission with requirements that will obtain emission reductions from the same emission reductions category.
The bll's passage is not expected to result in any significant fiscal impact on the TCEQ.
