The bill would add Section 251.0165 to Chapter 251, Transportation Code, to authorize certain counties to by resolution or order deny or designate access to or from a controlled access highway within the county and outside the limits of a municipality.
The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2007.
The Texas Department of Transportation (TxDOT) reports that the agency still maintains control in those situations in which the Federal Highway Department notifies the state that receipt of federal funds would be impaired, and when the department owns the access rights; therefore, TxDOT assumes provisions of the bill would have no fiscal impact to the state.
The provisions of the bill would affect only seven counties: Brazoria, Chambers, Fort Bend, Harris, Liberty, Montgomery, and Waller.
No significant fiscal implication to units of local government is anticipated.
